The Basics
Do you realize that simply having a will in place does not keep you out of probate court? In fact you will have to go to probate if you have a simple will. With this in mind, it will be costly and time consuming.
On the flip side a Revocable Living Trust is not controlled by probate as the probate court has no legal jurisdiction on a Revocable Living Trust. At a time of need for simplicity, fairness and speed to finalize your affairs, this is ideal for the family members you cherish the most.
Revocable Living Trusts
Ever wonder how to protect your assets? You remember those things you have worked so hard to get, i.e. your house, cars, retirement accounts, etc., more importantly; do you know how to keep them out of probate court to have peace of mind that your loved ones will receive everything you wanted them to get? Fischer, Carrillo & Associates can without question secure your interests so that no one can take or change your plans. The best part is, you keep control of everything
- Transfers property faster than a last will
- Does not require probate
- Avoid the cost and delays of probate
- Keep the details of your estate private
Pour Over Wills
A Pour Over Will, works in conjunction with your Revocable Living Trust, gives you one more level of protection for all your assets. Don't let the government take control of your belongings and interests.
Last Wills
You don't have too many assets and feel that a Revocable Living Trust would be over kill, no problem. You should have at minimum a standard will in place. With the standard will your heirs will be able to let probate court move as smoothly as possible to complete your estate. If you don't have at least a standard will, then the state takes control of your estate and distributes it as they wish or to whom ever has the better attorney.
- Distributes property to beneficiaries
- Names guardians for minor children
- Requires probate
- Specify funeral, burial, and other last wishes
Living Wills
Today, life support systems can keep a person’s body alive for years, even if the brain is no longer functioning or the person is in constant pain. A living will lets you specify decisions about artificial life support in advance. It not only ensures your wishes will be heard, but also protects your loved ones from having to make these difficult, deeply personal choices for you.
Fischer, Carrillo & Associates will also include a free Health Care Power of Attorney that lets you appoint someone you trust to make specific healthcare decisions on your behalf.
- Make advance decisions about artificial life support
- Special provisions, including directives for organ donation
- Free Health Care Power of Attorney
